All praise to JJ -- it&#039;s terribly important to America (and to the GOP) that there be conservatives who won&#039;t stand for whatever b.s. the Bush White House shovels at us.  Decrying the U.S. for imitating the Soviets shouldn&#039;t be hard, but it is, apparently.</description>

I&#039;m not so sure.  It seems that at as often as not the white house has tried to avoid just that sort of thing- i.e. letting the SCOTUS rule directly on their actions.  You saw that with Padilla when they suddenly transferred him to a civilian court when it looked like the SCOTUS might rule on the case.</description>
