This also runs into the hypocrisy issue. As an example, consider Sen. Kennedys enlighten response to the concept of producing renewable energy through wind. So the public face may not match what you "really want".

So are community values what we support in public (e.g. Mom and apple pie) or what is google searched (e.g. MILF and cream pie)? To put it another way, should the establishment of community value be handled like a voter proposition (e.g. requiring a certain number of registered voters to sign a petition in support) requiring a public statement of support, or should it be by proxy (e.g. the google search).

While the requirement for public support would undoubtedly be much more difficult to achieve, it would also be a sure sign of the public's standard.

But the google defense raises interesting possibilities. As an extreme example (because those tend to make the point better), imagine the the 'google test' became the standard. Now a rich individual or a group of like minded perverts could set the standard by doing a variety of google searches on say pedophilia, thereby indicating that for that community standards pedophilia is okay.

This is more than an interesting idea. There are so many questions regarding the terms "community" and "obscenity," as well as the changing norms throughout cultures. What was normal once is no longer normal. There was a time, sadly, in this country when interracial couples were forbidden, and now this is becoming more and more normal. How can prosecutors use twenty year old "norms" to convict individuals today?
