LICENSE TO LEGISLATE

George Will laments the Supreme Court making good public policy by overstepping its constitutional authority. Of course, since the Constitution gives the Court no direct authority to in fact interpret the Constitution, judicial review pretty much by definition oversteps the Court’s constitutional authority.
